The report is the first of its kind and provides a snapshot of the commercial conflict resolution in the United States and Canada and comes on the basis of a series of conferences held in the United States and Canada with recommendations for future conflict management. The report is expected to lead to a changed approach to commercial conflict resolution in the North American market. <\/span><\/span><\/p>\n\n\n\n<div class=\"wp-block-media-text alignwide is-stacked-on-mobile\"><figure class=\"wp-block-media-text__media\"><img loading=\"lazy\" decoding=\"async\" width=\"760\" height=\"457\" src=\"https:\/\/i2.wp.com\/cphmediation.com\/wp-content\/uploads\/2015\/11\/Skaermbillede-2021-08-06-kl.-11.22.27.png?resize=760%2C457\" alt=\"Sk\u00e6rmbillede 2021-08-06 kl. 11.22.27\" class=\"wp-image-850 size-full\" srcset=\"https:\/\/i2.wp.com\/cphmediation.com\/wp-content\/uploads\/2015\/11\/Skaermbillede-2021-08-06-kl.-11.22.27.png?resize=1024%2C616&amp;ssl=1 1024w, https:\/\/i2.wp.com\/cphmediation.com\/wp-content\/uploads\/2015\/11\/Skaermbillede-2021-08-06-kl.-11.22.27.png?resize=300%2C181&amp;ssl=1 300w, https:\/\/i2.wp.com\/cphmediation.com\/wp-content\/uploads\/2015\/11\/Skaermbillede-2021-08-06-kl.-11.22.27.png?resize=768%2C462&amp;ssl=1 768w, https:\/\/i2.wp.com\/cphmediation.com\/wp-content\/uploads\/2015\/11\/Skaermbillede-2021-08-06-kl.-11.22.27.png?w=1266&amp;ssl=1 1266w\" sizes=\"auto, (max-width: 760px) 100vw, 760px\" data-recalc-dims=\"1\" \/><\/figure><div class=\"wp-block-media-text__content\">\n<p class=\"wp-block-paragraph\">The report is based on data collected from conferences held in seven jurisdictions in the United States and Canada (Toronto, Austin, Baltimore, Los Angeles, Miami, New York, San Francisco) with the participation of parties, advisors, providers and decision makers including politicians. <\/p>\n<\/div><\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><span class=\"VIiyi\" lang=\"en\"><span class=\"JLqJ4b\" data-language-for-alternatives=\"en\" data-language-to-translate-into=\"da\" data-phrase-index=\"0\"><\/span><\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span class=\"VIiyi\" lang=\"en\"><span class=\"JLqJ4b ChMk0b\" data-language-for-alternatives=\"en\" data-language-to-translate-into=\"da\" data-phrase-index=\"0\">Overall, the report indicates a shift to a more collaborative and holistic approach to conflict resolution and states that there is generally an increased demand for mediation and ADR, which meets the parties&#8217; needs and a focus on continued collaborative relationships rather than litigation.<\/span><\/span><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u201cA fundamental finding of this report is the call for a shift from litigation as \u2018default\u2019 to a more encompassing field of dispute resolution that tailors solutions to the need of the parties. \u201c<\/em>\u2013 Laura Skillen, Executive Director IMI<\/p><\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\"><span class=\"VIiyi\" lang=\"en\"><span class=\"JLqJ4b ChMk0b\" data-language-for-alternatives=\"en\" data-language-to-translate-into=\"da\" data-phrase-index=\"0\">The report makes a comparison across the seven jurisdictions to identify key themes and general recommendations, which include recommendations for mandatory education in ADR in law and business schools, a shift towards more collaborative and problem-solving approaches to commercial conflict resolution, increased diversity and<\/span> <span class=\"JLqJ4b ChMk0b\" data-language-for-alternatives=\"en\" data-language-to-translate-into=\"da\" data-phrase-index=\"1\">quality of ADR providers and not least legislation to support the spread and use of mediation and ADR.<\/span><\/span><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u201cThis report is particularly relevant in the era of the Singapore Convention and increased demand for the professionalization of mediation practice.
